Ultraflex Components Warranty

Original Single Patient
Limited Lifetime Warranty & Disclaimer
Ultraflex Systems, Inc. (“Ultraflex”) warrants to the original fitted patient for a period of one (1) year withrespect to the entire product (if fabricated by Ultraflex) and for the fitted patient’s lifetime with respect to the Ultraflex component, that this Ultraflex product utilized is free from defects in workmanship and materials under normal use and service. Ultraflex will, at Ultraflex’s sole option, repair or replace any defective product or components during the warranty period completely without charge. This warranty shall run from the date of invoice and is valid for the original fitted patient only. Warranty service or replacement is available to the patient/user by delivering the Ultraflex product to the authorized O&P facility/clinician from which the patient received the product. This warranty is void if the product has been repaired, altered or modified by any person other than authorized employees or distributors of Ultraflex. This warranty is not transferrable and is expressly voided upon re-use by any other patient.
Some states do not allow the exclusion or limitation of incidental or consequential damages for consumer products, and some states do not allow limitations on how long an implied warranty lasts, so the above limitation or exclusions may not apply to the fitted patient. This warranty gives the fitted patient specific legal rights, and the fitted patient may also have other rights which vary from state to state.
WHAT IS NOT COVERED BY WARRANTY
This warranty does not cover:
1) Damage from tampering or repair by a non-authorized Ultraflex employee or distributor.
2) Any product which has been subject to misuse, abuse, neglect, damage in transit, accident or if damage occurs by reason of failure to follow written instructions enclosed with the product,determined at Ultraflex’s sole discretion.
3) Improper fit after initial fitting, due to changes in fitted patient limb volume or length.
4) Import duty, custom clearance fees and general expenses involved on products shipped to us from outside the U.S. market.
5) Any product that has, at any time, been worn or fit to any person other than the original fitted patient.
6) Adjustable Dynamic Response™ (ADR™) elastomers after 6 months of use or at Ultraflex’s discretion.

DISCLAIMERS
This warranty set forth above is in lieu of all warranties express, implied or statutory, including, without limitation, warranties for merchantability, fitness for a particular purpose and noninfringement and warranties arising from course of dealing or usage of trade. If, notwithstanding the above language, an implied warranty is held to exist, such implied warranty shall only extend for the lifetime of the initial purchaser of the product.
No employee, representative or agent of Ultraflex has any authority to bind Ultraflex to any affirmation, representation or warranty regarding the entire Ultraflex product or components except as expressly stated in this warranty.
